Who Can File a Wrongful Death Claim?
Under Colorado law (C.R.S. § 13-21-201), the following people may file a wrongful death action:
- First year: Surviving spouse
- Second year: Surviving spouse or children (if no surviving spouse, children alone)
- Beyond two years: Parents of the deceased (if no spouse or children)
